Withdrawal

Consumers have a fourteen-day right of withdrawal.

No voluntary right of withdrawal is granted to entrepreneurs.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen (14) days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last goods.

To exercise your right of withdrawal, you must inform us (ModiTech Service GmbH, Bernsdorfer Str. 291, 09125 Chemnitz, Germany, support@moditech.de, telephone: +49 37150340270) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the attached sample withdrawal form, which is, however, not mandatory. You can also fill in and submit the sample withdrawal form or another clear statement electronically on our website https://www.moditech.de/return/. If you make use of this option, we will send you without delay (e.g. by e-mail) a confirmation of receipt of such a withdrawal.

To meet the withdrawal deadline, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided proof that you have sent back the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to ascertain the nature, characteristics and functioning of the goods.

The right of withdrawal does not exist for the following contracts:

• Contracts for the supply of goods which are not prefabricated and for the production of which an individual choice or decision by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer (e.g. lock cylinders, padlocks, door fittings, security technology from the manufacturers SimonsVoss, SALTO Systems, Emloc, Hikvision, Milestone, AXIS as well as software personally licensed to the buyer).
• Contracts for the supply of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.
• Goods that are ordered from our upstream suppliers specifically for you on the basis of your order.

Consequences of Withdrawal for Digital Content

The right of withdrawal expires in the case of a contract for the supply of digital content that is not stored on a tangible data carrier even if we have begun to perform the contract after you have expressly agreed that we begin with the performance of the contract before the expiry of the withdrawal period and you have acknowledged that you lose your right of withdrawal by giving your consent to the start of the performance of the contract.

Special Notes

If you finance this contract by a loan and later withdraw from it, you are also no longer bound by the loan agreement, provided that both contracts form an economic unit. This is particularly to be assumed if we are at the same time your lender or if your lender makes use of our cooperation with regard to the financing. If the loan has already been made available to us when the withdrawal becomes effective, your lender shall, in relation to you, enter into our rights and obligations under the financed contract with regard to the legal consequences of the withdrawal or the return of the goods. The latter does not apply if the present contract concerns the acquisition of financial instruments (e.g. securities, foreign exchange or derivatives).

If you wish to avoid a contractual obligation as far as possible, make use of your right of withdrawal and also withdraw from the loan agreement if you are also entitled to a right of withdrawal for that agreement.
